The driver who collided with the car two young best friends were traveling in was booked on suspicion of DUI and homicide in January, but as of Thursday still had not been formally charged.

"It just doesn't seem right, something's fishy," said Simone Daly, Haven Penman’s mother.

Penman, Kylan Allen and Allen’s grandmother died on Jan. 18 after getting into a crash with an alleged drunken driver near Riverside and Placentia avenues, according to Colton police. The motorist, 29-year-old Michael Hughes, was booked on suspicion of driving under the influence and homicide.

The San Bernardino District Attorney’s office told NBC4 the case is still under review, specifically whether Allen’s grandmother may have failed to yield.

But even if that’s true, the victims’ mothers hope driving under the influence will still be punished.

"This gentleman should never have been on the road," said Daly.

Authorities said Hughes had a blood alcohol level of .14 at the time of the crash, nearly twice the legal limit of .08.

A video of the girls recorded an hour before they left in the car to attend a church function shows the pair dancing and laughing.
